The European Union’s highest court has dismissed an attempt a Dutch cheese maker copyright its cream cheese. The ruling means that a person or company cannot legally own the taste food and prevent others copying it.
The Dutch court asked guidance the European Court of Justice, or ECJ. The ECJ judges said, “The taste a food product is not eligible copyright protection.”
They said unlike works writing, photography, movies and music, the taste a food product cannot be identified “precision and objectivity.”
The judges added that the taste food depends personal taste and experience.
This is not the first time that the court had rule a dispute about food.
